CITY SIGHTSEEING SAN DIEGO DISCLAIMERS AND LIMITATIONS

PLEASE READ THIS CAREFULLY BEFORE BOARDING THE TOUR VEHICLE

This tour is taken at your own risk. By taking this tour, you hereby release City Sightseeing San Diego, Inc., its employees and agents, and those representatives, administrators or agents of the company or person who has provided you with this ticket of any responsibility for any loss, damage, injury or claim which may occur to you or your belongings before, during or after the tour is completed. City Sightseeing San Diego, Inc. is not responsible for any personal belongings left inside the vehicle upon the completion of the tour. The foregoing limitations of liability apply to and include, but are not limited to, losses, damages, injuries or claims resulting from conditions over which City Sightseeing San Diego Inc., has control as well as those conditions and occurrences over which it has no control, unless said losses, damages or injuries are the direct result of the willful, deliberate and/or malicious acts of City Sightseeing San Diego, Inc. No employee or agent may enlarge or alter our liability herein, either orally or otherwise. Your use of your ticket to board the tour bus shall constitute your acknowledgment and acceptance of the foregoing limitations of liability.

Downtown San Diego is undergoing constant construction and enhancements in order to improve our beautiful city. These could cause unforeseen delays in the tour schedule but will not affect your tour experience. We apologize for any inconvenience this may cause.

As a condition of your participation in the City Sightseeing San Diego tour, you agree to remain in your seat at all times while the tour vehicle is moving. You are required to obey all host/hostess safety instructions at all times. Adults traveling with children are responsible for keeping children seated for the entire duration of the tour. Alcoholic beverages are not permitted and no smoking is allowed. Throwing any objects from the vehicle and/or littering is prohibited and is subject to prosecution. Your ticket should be kept with you at all times and our personnel can request to see it at any time.

Your City Sightseeing San Diego ticket entitles you to a city tour by bus. Bay ferry tickets are not included in the price of your ticket. To go to Coronado by ferry, you should purchase a ticket from your tour host/hostess or from the ferry sales office. City Sightseeing San Diego, Inc. shall not be liable for any inconvenience, loss, damage, injury, or delay, resulting from any acts or omissions of the ferry service.

For ferry tickets and for all other attractions available for purchase from City Sightseeing San Diego, Inc., it acts solely as an agent. It does not assume any liability for any claim, loss, damage, or injury, including, without limitation, any property damage or bodily injury resulting therefrom, whether due to any act or omission by the operator or by City Sightseeing San Diego Inc, or any of its employees or agents or by any other person, or from any other reason.

City Sightseeing San Diego, Inc., reserves the right to cancel or alter our tour, our narration or our narration language at any time and as circumstances demand, and to use any type of vehicles, number of vehicles or leased equipment as deemed necessary in its sole discretion. City Sightseeing San Diego, Inc., reserves the right to refuse service to any passenger, group or member of any tour and reserves the right to cancel the tour to a particular person or group of people in its sole discretion.

By boarding the tour bus, you hereby agree and warrant that you have read and understand the contents hereof and that you agree to each and every term and condition herein.
